Arraigo, regularisation through ties

For individuals already in Spain who can prove a sufficient period of residence and meet the conditions for social, employment, or family ties.

Extraordinary regularisation closed

The extraordinary regularisation opened by Royal Decree 316/2026 ended on 30 June 2026. This deadline is not extendable. Many websites continue to present it as open. The five types of arraigo described below remain open and are not affected by this closure.

Required documents

The list below is exhaustive. Each document is described as it must be submitted, including the most common errors that lead to rejection.

Identity

Form EX-10

Official form EX-10, common to the five arraigo modalities, completed and signed. The requested modality must be ticked accurately: arraigo de segunda oportunidad, sociolaboral, social, socioformativo or familiar.

Common errors

  • Incorrectly identified modality. The arraigo social no longer requires an employment contract since the reform; this requirement now falls under the arraigo sociolaboral.
  • Parents of a minor of Spanish nationality no longer fall under the arraigo familiar but under Article 94.
  • Form from a version prior to the reform.

Full, valid passport

Full copy of the passport, all pages, including blank pages. The passport must be valid on the date of submission.

Common errors

  • Partial copy limited to the identity page and stamped pages.
  • Expired passport, to be renewed at the consulate of the country of origin before any submission.

Certificado de empadronamiento histórico

Historical certificate issued by the town hall, establishing the continuity of residence in Spain for the required period. The required duration is two years for the segunda oportunidad, sociolaboral, social and socioformativo modalities, with a maximum of ninety days of absence. The arraigo familiar is not subject to any minimum duration. Crucial point: time spent as an asylum seeker is not counted, and an asylum application cannot be maintained simultaneously with an arraigo application. The Tribunal Supremo (Supreme Court) has expressly confirmed this point.

Common errors

  • Current certificate requested instead of the historical certificate, which is the only one that establishes continuity.
  • Asylum application periods counted as duration of stay.
  • Interruptions in the padrón registration showing a break in continuity that must then be justified by other means.
  • No regulation specifies the validity period of this certificate. Observed practice is three months.

Criminal record certificate from the country of origin

Certificate issued by the authorities of the country or countries of residence for the last five years, apostilled and accompanied by a sworn translation into Spanish. Note on the current state of the law: on 8 July 2026, the Tribunal Supremo overturned the automatic refusal based on the existence of a prior criminal history. The official information sheets, updated in April 2026, do not yet reflect this decision.

Common errors

  • Consular legalisation instead of an apostille for Algerian documents issued on or after 9 July 2026.
  • Non-sworn translation.
  • Certificate not covering all countries of residence.

Resources

Employment contract or contracts

Applicable to arraigo sociolaboral (a regularisation procedure based on work and social integration). One or more contracts totalling at least twenty hours per week in aggregate, for a duration of more than ninety days, remunerated at the national minimum wage or the pro-rata collective agreement minimum. The 2026 SMI is set at 1,221 euros over fourteen monthly payments.

Common errors

  • Single contract of less than twenty hours when accumulation is now permitted.
  • Remuneration below the sector's collective agreement minimum, which often takes precedence over the SMI.
  • Contract not signed by the employer.

Informe de inserción social

Applicable to arraigo social and to arraigo socioformativo. Report issued by the autonomous community of residence certifying the applicant's integration. Sources differ on the required level of resources for the integration report route, between 100% and 200% of the IPREM. Your adviser verifies the criterion applied by your autonomous community before preparing the case.

Common errors

  • Application submitted to the town hall when the autonomous community has jurisdiction, or the reverse depending on the territory.
  • Report requested too late: processing times vary significantly from one autonomous community to another.

Education

Enrolment or commitment to undertake training

Applicable to the arraigo socioformativo. Proof of enrolment in a course, or a commitment to undertake a course, that meets the conditions set by the regulations.

Common errors

  • Ineligible course.
  • Commitment written without mentioning the duration or the provider.

Other documents

Proof of family link

Applicable to arraigo familiar and certain arraigo social pathways. Civil status documents establishing the link with a minor or a disabled person who is a national of Spain, a Member State of the European Union, the European Economic Area, or Switzerland. Apostilled and translated documents.

Common errors

  • Confusion between arraigo familiar and the pathway under Article 94 applicable to parents of a Spanish minor.
  • Birth certificate not apostilled.

Proof of payment for tasa 790-052

Form 790, code 052, epígrafe 2.3.1, in the amount of 38.28 euros according to Orden PJC/617/2025. The tax is paid after submission, upon instruction from the administration.

Common errors

  • The amount of 102.58 euros commonly cited on private websites does not appear in any current regulation.
  • Incorrect epígrafe leading to a payment not allocated to the case.

Timeframes

The resolution period is three months. Administrative silence is equivalent to a refusal. This point is crucial and frequently overlooked: in the absence of a response within three months, the appeal periods begin to run, one month for an administrative appeal and two months for a judicial appeal. Passive waiting results in the loss of these appeal options.

Official taxes

Tax 790-052, epígrafe 2.3.1: 38.28 euros, according to Orden PJC/617/2025. Residence card (TIE), tax 790-012, first issue: 16.08 euros. The amount of 102.58 euros circulated on many private websites does not appear in any current regulation.
